José Humberto Frías
D´Empaire
José Humberto Frías represents clients in domestic and international arbitration proceedings, including international investment arbitration disputes.
He also specializes in antitrust, regulatory and Public Law matters.
Prior to joining D’Empaire in 2005, José Humberto worked as an attorney at Venezuela’s antitrust regulatory authority (Procompetencia) and as an international associate at the New York office of Skadden, Arps, Slate, Meagher & Flom LLP in 2001.
He studied Law at Universidad Católica Andrés Bello, Caracas (1993) and obtained a Master of Laws (LL.M.) at McGill University, Montreal (2000). He currently teaches Philosophy of Law at the Universidad Católica Andrés Bello.
Among others, José Humberto has represented: a Peruvian investor in an Additional Facility proceeding of the International Center for Settlement of Investment Disputes (ICSID) (No. ARB(AF)/18/6) against the Bolivarian Republic of Venezuela; a Spanish investor in a proceeding under the rules of the United Nations Commission on International Trade Law (UNCITRAL) (No. PCA AA737) against the Bolivarian Republic of Venezuela; two investors from Luxembourg and Portugal in two proceedings under the International Center for Settlement of Investment Disputes (ICSID) rules (Nos. ARB/11/26 and ARB/12/23) against the Bolivarian Republic of Venezuela; two Spanish investors in a proceeding under the rules of the United Nations Commission on International Trade Law (UNCITRAL) (PCA Case No. 2013-3) against the Bolivarian Republic of Venezuela; a family of Spanish investors in two proceedings (Case No. ARB(AF)/16/1 and Case No. 2016-8) against the Bolivarian Republic of Venezuela; an investor from Barbados in a proceeding under the International Center for Settlement of Investment Disputes (ICSID) rules (No. ARB/11/31) against the Bolivarian Republic of Venezuela; a German company in a proceeding under the rules of the International Court of Arbitration of the International Chamber of Commerce (ICC) in a claim by a Venezuelan company; and a Spanish company in a proceeding under the ICC rules in a lawsuit filed by a Venezuelan company.
José Humberto has also participated in the most important antitrust cases in Venezuela in recent years, and has represented Venezuelan and international clients (including Telecom Italia, Cemex, Sanofi-aventis, among others) in several important cases before the Constitutional Chamber and Administrative Policy of the Supreme Court of Justice.
José Humberto has advised clients in complex administrative and regulatory matters, including the representation of Santander, Cemex, Ternium and AEI Energy in nationalizations.
