Noronha proposes collective suspension on second request of access

May 02, 2019

The president of the Superior Court of Justice, the minister João Otávio de Noronha, proposed to the Special Court that, if there is a second request of access in the same lawsuit, the procedure of suspension need to be made on a collective way for all the ministers of the session.

The proposal still depends on the approval of a regimental amendment and would be valid, in principle, only for the Special Court.

It is important the establishment of a deadline so that the files can be returned to judgment when it is requested the access to the files to give the vote. All the jurisdictions will be benefited with this because the postponement of a decision causes serious damages to the parties. The Justice that is slow, it is failed.
