New Procedures and Priority Deadlines for Energy Permit Applications

Greenberg Traurig - On 17 October 2025, the Secretariat of Energy (‘SENER’) published in the Official Gazette of the Federation ("DOF") the Call for Priority Attention to Applications for Electricity Generation and Interconnection Permits to the National Electricity System (‘Call’).

The most relevant points of the Call are summarised below:
 
• Purpose: The purpose of the Call is to establish a procedure to expedite the granting of generation permits for strategic projects aligned with the sector’s binding planning.
 
• Scope: It is aimed at those interested in applying for electricity generation permits and developing strategic projects in the sector with a capacity equal to or greater than 0.7 MW.

• Strategic projects: The projects referred to in the Call for Proposals must be aligned with the criteria of the Electricity Sector Development Plan. The requirements that these projects must meet in terms of areas, technologies, capacity, type of generation, power, and estimated cost of reinforcement works are summarised in the Sole Annex to the Call for Proposals.

• Single Window for Electricity Permits: The Single Window for Strategic Projects (VUPE) is enabled, through which interested parties can register their expression of interest, make the corresponding payments, receive notifications, and follow up on projects in the sector.
 
• Requirements: those interested in obtaining generation permits under the Call for Proposals must submit an expression of interest and a request for interconnection studies to the National Energy Control Centre (CENACE), in addition to complying with all the requirements established in the current regulations for the sector. 

I. Modification to the Call for Proposals
With regard to the schedule of stages, on 24 October 2025, the modification of the timelines for each stage of the Call for Proposals was published in the DOF, which are as follows:



II. Obtaining generation and interconnection permits
Completing the registration for the Call for Proposals and making the corresponding payments for the interconnection studies does not guarantee that the permit will be obtained, but only ensures preferential treatment within the administrative process.
If the formal application is rejected by the authority, the applicant retains the right to submit a new application, although it will no longer be eligible for priority consideration.
