NHG advises Proparco and DEG on key financing for cross-border Fiber Optic infrastructure
NHG advised SOCIÉTÉ DE PROMOTION ET DE PARTICIPATION POUR LA COOPÉRATION ECONOMIQUE S.A. ("Proparco"), and DEUTSCHE INVESTITIONS - UNDENTWICKLUNGSGESELLSCHAFT MBH ("DEG"), as lenders, in connection with the fi nancing granted to CTG Control, S.A.P.I. de C.V. and Bicentel LLC to design, construct and operate a two-segment dark fi ber optic cable route and related infrastructure running from Santiago de Querétaro, Querétaro, Mexico to Phoenix, Arizona, United States of America, including the design, construction, operation and maintenance of all network infrastructure required to establish a continuous transborder telecommunications network, including 29 in-line amplifiers.
NHG provided comprehensive legal advice to the lenders in connection with the due diligence of the project, the structuring and implementation of the fi nancing (including the collateral package), regulatory framework applicable to the construction and operation of the project, and general permitting, environmental, social, tax and insurance matters.
NHG’s work included reviewing key regulatory, environmental and social authorizations to assist the lenders in assessing the project’s feasibility, legal risks and compliance with applicable Mexican laws and relevant international standards.
