Regulations of the Electricity Sector Law in Mexico

Galicia - On October 3, 2025, the Regulations of the Electricity Sector Law (the "Regulations") were published in the Official Gazette of the Federation. The purpose of the Regulations is to clarify and detail the provisions of the Electricity Sector Law ("LSE") that primarily regulate the planning and operational control of the National Electricity System ("SEN"), as well as the generation, storage, and communication of electric energy, and the public service of transmission and distribution of electric energy. The Regulations entered into force on October 4, 2025.

The Regulation develops concepts generally established in the LSE and addresses some of the questions that arose since the LSE came into force on March 19, 2025. On the positive side, unlike what happened during the previous six-year term, in drafting the Regulation, SENER maintained an open communication process with various participants in the Mexican electricity sector, including representatives of the private sector. Therefore, the provisions of the Regulation reflect some of the concerns that had been expressed regarding the content of the LSE.

However, there are still a considerable number of issues that the Regulation establishes that must be subsequently regulated through administrative provisions, criteria, and guidelines to be issued by both the Ministry of Energy ("SENER") and the new National Energy Commission ("CNE").
