Cuatrecasas discusses arbitration challenges between Asia and Latin America at Hong Kong Arbitration Week
By Crystal Lo · Head of China Desk

Growing trade and investment ties between Asia and Latin America are increasing the importance of international arbitration as a dispute resolution mechanism. In sectors such as infrastructure, energy, natural resources and international trade, companies face cross-border disputes involving different laws, legal cultures and regulatory frameworks.
In this context, Cuatrecasas took part for the third consecutive year in Hong Kong Arbitration Week 2026, organized by the Hong Kong International Arbitration Centre (HKIAC), with a session titled Asian Disputes in Latin America: Trends and Challenges.
The event, held on 23 October in Hong Kong, brought together international arbitration professionals to examine the evolution of commercial disputes, challenges in enforcing awards and the interaction between civil law and common law systems.
Cuatrecasas Madrid partner Alfonso Gómez-Acebo led the session, with contributions from Xiongchao Peter Chen of Fangda Partners; Evaristo Treviño Berlanga of La Nao Consulting; and Fedelma C. Smith-Ruiz, an independent practitioner.
Growth in Latin American cases administered in Hong Kong
HKIAC deputy secretary-general HKIAC Kiran Sanghera opened the session by highlighting the institution’s relationship with Latin America, which dates back approximately a decade.
Over the past six or seven years, HKIAC has administered nearly 40 cases involving Latin American parties.
Brazil accounts for the largest number of Latin American parties in proceedings administered by HKIAC, followed by Panama, Mexico and Belize. Cases have also involved Argentina, Colombia, Uruguay, Costa Rica and Guatemala.
In 2025, Brazil entered the top ten jurisdictions of origin for HKIAC users for the first time, becoming the first Latin American country to reach that position.
This marks a milestone in the development of commercial and investment disputes between Asia and Latin America.
